PLANNING AND ZONING COMMISSION
PUBLIC HEARING
JANUARY 9, 2017


The Gordon County Planning Commission held a Public Hearing on Monday, January 9, 2017 at 6:00 p.m. in the Conference Room of the Gordon County Administration Building for the purpose of hearing variance and zoning change requests.

Members present were:

Randy Rule, Jerry Lovelace, Butch Layson, Eddie Smith, and Nathan Serritt

Butch Layson called the meeting to order and advised all present of the sign-up sheets available for those who wish to address the Planning Commission on any of the zoning or variance change applications.

APPROVAL OF MINUTES

A motion was made by Jerry Lovelace to approve the minutes of the previous meeting of December 12, 2016. Eddie Smith seconded the motion. All voted aye. The minutes were approved as written.

REZONING APPLICATION #Z16-26, STANLEY SIMPSON
(Tabled from December 12, 2016)

Vice-Chairman Layson read rezoning application #Z16-26, Stanley Simpson requesting to rezone a 1.47 acre tract located at 5200 Fairmount Hwy., SE, Calhoun from A-1 to CH, for a used car sales business and use the duplex as office space. Mr. Simpson represented the request stating that he had followed up on the requirements he would have to meet with Georgia D.O.T. and the Gordon County Public Works Department on the driveway permits since the last meeting and that it would be cost efficient for him to proceed with the rezoning as discussed at the prior month meeting. All adjoining property owners had been notified.

Ursula Desrosier, Zoning Administrator for Gordon County, recommended that the rezoning request identified as Application #Z16-26 be denied.

Nathan Serritt made the motion to recommend denial of the rezoning application identified as #Z16-26. With the lack of a second, Chairman Rule ask again for a recommendation. Butch Layson made the motion to recommend approval of the rezoning application #Z16-26 from A-1 to CH. Jerry Lovelace seconded the motion. Eddie Smith voted with the motion. Nathan Serritt opposed the motion. The vote was 3-1 to recommend approval of the rezoning request. The recommendation for approval was sent to the Board of Commissioners.

VARIANCE APPLICATION #V16-16 & REZONING APPLICATION #Z16-27, MITCHELL WAYNE WORLEY

Chairman Rule read variance application #V16-16 and rezoning application #Z16-27, Mitchell Wayne Worley for a 1.52 acre tract located at 253 Rock Creek Road, Calhoun. Mr. Worley represented the requests explaining that the property was subdivided into two tracts and that he had inherited the back tract from his father (his brother had inherited the front tract). He has removed the existing mobile home and would like to build a house for his son. The variance is to reduce the required county road frontage for R-1 zoning from 75 feet to a 15 foot easement and the rezoning is from A-1 to R-1. All adjoining property owners had been notified.

Ursula Desrosier, Zoning Administrator for Gordon County, recommended that the variance request identified as Application #V16-16 be approved, with the condition that evidence of a permanent easement for access is submitted to the Gordon County Planning and Development Department and on rezoning request identified as Application #Z16-27 it is recommended for approval from A-1 to R-1.

On variance request #V16-16, Jerry Lovelace made the motion to approve as requested; with the condition that evidence of a permanent easement for access is submitted to the Gordon County Planning and Development Department. Eddie Smith seconded the motion. All voted aye. The variance was granted. The thirty-(30) day appeal period was explained.

On rezoning request #Z16-27, Eddie Smith made the motion to approve the request from A-1 to R-1. Nathan Serritt seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.

REZONING APPLICATION #Z16-28, TONY TEMPLE

Chairman Rule read rezoning application #Z16-28, Tony Temple, requesting to rezone a 1 acre tract located at 262 Newtown Road, Calhoun from A-1 to CH. Mr. Temple represented the request explaining that this property was subdivided and must be brought into compliance before any building permit could be issued, regardless of use, but he would like to build a 42 x 48 foot shop for storage of his construction equipment. All adjoining property owners had been notified.

Ursula Desrosier, Zoning Administrator for Gordon County, recommended that the rezoning request identified as Application #Z16-28 be approved and that the Future Land Use Map be amended.

Jerry Lovelace made the motion to approve the rezoning application identified as #Z16-28 from A-1 to CH and an amendment is made to the Future Land Use Map. Nathan Serritt seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.

VARIANCE APPLICATION #V16-17, KEITH NICHOLS
(Property Owners: Jerry & Nancy Nichols)

Chairman Rule read variance application #V16-17, Keith Nichols requesting a variance to increase the size of a metal structure from 500 feet to 2,500 feet on a 42.54 acre tract located at 280 Owens Chapel Road, Calhoun. Mr. Nichols represented the request explaining that cost, the longevity and structural integrity is why he would like to build this metal storage structure with 3 roll-up doors. All adjoining property owners had been notified.

Ursula Desrosier, Zoning Administrator for Gordon County, recommended that the variance request identified as Application #V16-17 be approved as requested.

Butch Layson made the motion to approve the variance application identified as #V16-17 as requested. Jerry Lovelace seconded the motion. All voted aye. The variance was granted. The thirty-(30) day appeal period was explained.

REZONING APPLICATION #Z16-29, JAMES MARK BUNCH

Chairman Rule read rezoning application #Z16-29, James Mark Bunch, requesting to rezone a 1.57 acre tract located at 5480 Nickelsville Road, Resaca from A-1 to R-1. Mr. Bunch represented the request explaining that this property was a family division and he needed to bring it into compliance to build a house. All adjoining property owners had been notified.

Ursula Desrosier, Zoning Administrator for Gordon County, recommended that the rezoning request identified as Application #Z16-29 be approved.

Nathan Serritt made the motion to approve the rezoning application identified as #Z16-29 from A-1 to R-1. Eddie Smith seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.

VARIANCE APPLICATION #V16-18, HAROLD ZACHARIAS

Chairman Rule read variance application #V16-18, Harold Zacharias requesting a variance to reduce setback requirements to the front, side, and rear of a .49 acre tract located at the corner of Beamer Circle and Overland Drive, Calhoun. Mr. Zacharias represented the request explaining that this being a corner lot it makes is difficult to construct a new house since you have to meet setback requirements for both streets and both side lot lines pull in. The house across the street is already 20 feet from the ROW. He added he would ask to be able to reduce the required setbacks from 40 feet from the ROW to 25 feet, and from 20 feet on the sides to 10 feet, and from 50 feet in the rear to 30 feet. All adjoining property owners had been notified.

Ursula Desrosier, Zoning Administrator for Gordon County, recommended that the variance request identified as Application #V16-18 be approved with the condition that only one street is allowed the 25 feet from the ROW.

Butch Layson made the motion to approve the variance application identified as #V16-18 with the condition that only one street is allowed the 25 feet from the ROW. Jerry Lovelace seconded the motion. All voted aye. The variance was granted. The thirty-(30) day appeal period was explained.

REZONING APPLICATION #Z16-30, TON TRAN

Chairman Rule read rezoning application #Z16-30, Ton Tran, requesting to rezone a 1.82 acre tract located at 3274 Rome Road, Plainville from CG to A-1. Moon Tran represented the request explaining that this business had shut down in 2006 and that they would like to rezone back to agricultural and incorporate it to the 37.80 acre poultry farm. All adjoining property owners had been notified.

Ursula Desrosier, Zoning Administrator for Gordon County, recommended that the rezoning request identified as Application #Z16-30 be approved.

Eddie Smith made the motion to approve the rezoning application identified as #Z16-30 from CG to A-1. Butch Layson seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.

REZONING APPLICATION #Z16-31, TED KING
(Applicant: Patrick Davis)

Chairman Rule read rezoning application #Z16-31, Ted King (applicant: Patrick Davis), requesting to rezone a 15.28 acre tract and a 34.64 acre tract located on Union Grove Road and Belwood Road, Calhoun from A-1 to I-2. Mr. Davis, with 3D Development, LLC, represented the request explaining the need to rezone these 2 parcels to maximize the usable area of the property for development, to accommodate the development of a proposed travel stop, and to match the existing trend of adjacent property zonings to industrial. He also added that access to the travel plaza would be from Belwood Road. All adjoining property owners had been notified.

Ursula Desrosier, Zoning Administrator for Gordon County, recommended that the rezoning request identified as Application #Z16-31 be approved with an amendment to the Future Land Use map.

Jerry Lovelace made the motion to approve the rezoning application identified as #Z16-31 from A-1 to I-2 and an amendment is made to the Future Land Use Map. Nathan Serritt seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.

VARIANCE APPLICATION #V16-19, KURT SUTHERLAND

Chairman Rule read variance application #V16-19, Kurt Sutherland requesting a variance to reduce setback requirements to the property line for a 27.20 acre tract located at 5168 Fairmount Hwy., Calhoun. Mr. Sutherland represented the request explaining that he would like to build two 40 x 400 chicken breeder houses and he needs a variance from the county requirements of 200 feet for setback from property line because of the terrain and width of the property. All adjoining property owners had been notified.

Ursula Desrosier, Zoning Administrator for Gordon County, recommended that the variance request identified as Application #V16-19 be approved.

Nathan Serritt made the motion to approve the variance application identified as #V16-19 to reduce the setback from the required 200 feet from property lines as requested. Eddie Smith seconded the motion. All voted aye. The variance was granted. The thirty-(30) day appeal period was explained.

ELECTION OF CHAIRMAN AND VICE-CHAIRMAN

Ursula Desrosier, Zoning Administrator for Gordon County, announced that the Board of Commissioners was going to hold a meeting the following night and appointments would be made for the expired terms of Randy Rule, Butch Layson, and Jerry Lovelace and that the election for the Chairman and Vice-Chairman would need to be held at the next meeting. Butch Layson made the motion to table the election until the next meeting. Eddie Smith seconded the motion. All voted aye. The election will be held at the next meeting.

ADDITIONAL BUSINESS

There being no additional business, Jerry Lovelace made the motion to adjourn. Nathan Serritt seconded the motion. All voted aye. The meeting was adjourned at 7:10 p.m.
