GORDON COUNTY PLANNING AND ZONING COMMISSION
PUBLIC HEARING MINUTES
FEBRUARY 8, 2021


The Gordon County Planning Commission held a Public Hearing on Monday, February 8, 2021 at 6:00 p.m. in Calhoun’s Gem Theater across from the Gordon County Administration Building for the purpose of hearing variance and zoning change requests.

Members present were:
Randy Rule, Eddie Smith, Jerry Lovelace, Nathan Serritt, and Sabrina Poole

Randy Rule called the meeting to order and advised all present of the sign-up sheets available for those who wish to address the Planning Commission on any of the zoning or variance change applications. Chairman Rule also welcomed all guests including Jim Ledbetter, Gordon County Administrator, and Pam Madison, Adairsville City Administrator.

APPROVAL OF MINUTES

A motion was made by Jerry Lovelace to approve the minutes from the previous meeting of January 11, 2021. Nathan Serritt seconded the motion. All voted aye. The minutes were approved as written.

VARIANCE APPLICATION #V21-01 REZONING APPLICATION #Z21-01, TINA ESCALANTE (appl.) JEFFREY & LISA SNODGRASS (owner)

Chairman Rule read variance application #V21-01 and rezoning application #Z21-01, Tina Escalante (appl.), Jeffrey & Lisa Snodgrass (owner), requesting a variance on a 8.14 acre tract located at 152 Timms Loop, Calhoun. Ms. Escalante and Mr. and Ms. Snodgrass all represented the request explaining that a variance is requested to allow access, using an existing 25 foot easement to the tract and subdivide the property with an existing house to build a new house on the balance of the tract and therefore needing to rezone to RA-1. This existing easement is currently shared by 3 homes. All adjoining property owners had been notified.

On Variance Application #V21-01, Jerry Lovelace made the motion to approve the variance as requested. Eddie Smith seconded the motion. All voted aye. The variance was granted. The thirty-(30) day appeal period was explained.

On Rezoning Application #Z21-01, Eddie Smith made the motion to approve the rezoning request from A-1 to RA-1. Jerry Lovelace seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.

VARIANCE APPLICATION #V21-02 & REZONING APPLICATION #Z21-02, THOR EQUITIES, LLC (appl.) TIMOTHY I. MOORE (owner)

Chairman Rule read variance application #V21-02 and rezoning application #Z21-02, Thor Equities, LLC, applicant and Timothy I. Moore, owner on 84 acre tract and a 115 acre tract located on Highway 41, South, Adairsville. Terry Brumlow, a local attorney, and Joel DelliCarpini with Thor Equities represented the requests stating that the variance request is to reduce the buffer strip from 100 feet on I-1 zoning, down to 20 feet on the North, East, and West side of the property. The variance request is for only 84 acres of the 115 acre tract. The rezoning is to rezone the entire 115 acres from A-1 to I-1. The construction will be for a spec building of about 1 million square feet and the placement is because of the stream on the property and not to touch the floodplain. A drawing of the proposed building placement on the property, as well as photos of other developments by Thor Equities in Chicago, New York, and Los Angeles was presented to the Planning Commission. Area and adjoining property owners Randy Cash, Kenny Rogers, Taylor Forsyth, Norman Parker, Fred Arrigoni, Alberta Jones, and Pam Madison, City Manager for Adairsville, spoke in opposition to the development with concerns of runoff, noise, chemical pollution, drainage into lake, increased traffic, decreased property values, lights, etc. Mr. Brumlow and Mr. DelliCarpini stated that the development would have to comply with all state regulations for storm water management. All adjoining property owners had been notified.

On variance application #V21-02, Nathan Serritt made the motion to approve the variance as requested to reduce the county buffer requirements from 100 feet on I-1 zoning, down to 20 feet on the North, East, and West side of the property. Jerry Lovelace seconded the motion. Sabrina Poole and Eddie Smith voted against the motion. Chairman Rule voted with the motion. The vote was 3-2 to approve. The variance was granted. The thirty-(30) day appeal period was explained.

On rezoning application #Z21-02, Jerry Lovelace made the motion to approve the rezoning request from A-1 to I-1. Nathan Serritt seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.

ADDITIONAL BUSINESS

There being no additional business, Nathan Serritt made the motion to adjourn. Jerry Lovelace seconded the motion. All voted aye. The meeting was adjourned at 7:06 p.m.
