GORDON COUNTY BOARD OF COMMISSIONERS
REGULAR MEETING MINUTES
MARCH 29, 2016


The Gordon County Board of Commissioners held their Regular Meeting on Tuesday, March 29, 2016, at 6:00 p.m. in the conference room of the Administration Building.

Chairman Hood called the meeting to order.

EMPLOYEE RECOGNITION

Commissioner Sexton read the list of employees with anniversary hire dates in April. Commissioner Steward drew the name of Jonathan Pressley with the Fire Department as Employee of the Month for April.

APPROVAL OF MINUTES

Chairman Hood asked if there are any additions, omissions, or deletions to the Minutes for the Work Session March 15, 2016, and the Regular Meeting March 15, 2016. Commissioner Cunningham made a motion to approve the minutes. Commissioner Sexton seconded the motion and Commissioners Cunningham, Sexton, Gazaway and Steward voted aye. Motion approved.

ADMINISTRATOR’S REPORT

County Administrator King read the report into the record.

COMMISSIONERS’ REPORT

None

PUBLIC HEARING FOR ZONING

Commissioner Cunningham made a motion to open the public hearing for zoning. Commissioner Gazaway seconded the motion and Commissioners Cunningham, Gazaway, Steward, and Sexton voted aye.

APPLICATION #Z16-03 BRENDA G. ARNOLD’S REQUEST TO REZONE FROM A-1 TO R-1

County Attorney Ledbetter read the application for rezoning, and advised that this is in connection with the next application #Z16-04 for Ms. Arnold. This request is to rezone from A-1 to R-1 to subdivide out .48 acres from the 1.48 acres to build a house. The remaining 1.0 acres is requested in application #Z16-04 to rezone from A-1 to CG and will be used for a car lot. The Planning Commission finds that these are suitable uses and sends their recommendations for approval of both rezoning requests to the Board of Commissioners. Attorney Ledbetter further advised that Environmental Health advised that the septic tank and drain field needs to be located, along with future repair areas, and stay on the lot with the house. Also, drain field does not need to encroach on adjoining property. Attorney Ledbetter advised that this should be included as a condition of the rezoning from A-1 to R-1. Mitchell Washington spoke concerning the property and stated that this is his family’s property and that he knows where the drain field is located and that it, in no way, encroaches on adjoining property. County Attorney wanted Mr. Washington to understand that if the Board approves this rezoning it will be a condition of the rezoning that the drain field has been located and identified and that all will be correct.

Commissioner Cunningham made a motion to approve the rezoning from A-1 to R-1 with the condition that the drain field is located and that it does not encroach on adjoining property. Commissioner Gazaway seconded the motion and Commissioners Cunningham, Gazaway, Steward, and Sexton voted aye. Motion passed.

APPLICATION #Z16-04 BRENDA G. ARNOLD’S REQUEST TO REZONE FROM A-1 TO CG

Commissioner Gazaway made a motion to approve application Z16-04 from A-1 to CG. Commissioner Cunningham seconded the motion and Commissioners Gazaway, Cunningham, Steward, and Sexton voted aye. Motion passed.

APPLICATION #Z16-05 CHARLES AND NANCY RICHARDS’ REQUEST TO REZONE FROM A-1 TO MU

County Attorney Ledbetter announced to the Board that Mr. Terry Brumlow, the attorney for the applicant, has sent an email asking that this application be tabled until the April 19, 2016 meeting of the Board when there is another matter concerning this property coming before the Board on that date. Attorney Ledbetter also advised anyone that was in attendance concerning this matter that the Board would hear this at their next meeting on April 19.

Commissioner Cunningham made a motion to table application #Z16-05 until April 19, 2016. Commissioner Gazaway seconded the motion and Commissioners Cunningham, Gazaway, Steward, and Sexton voted aye. Motion passed.

APPLICATION #Z16-06 MARVIN L. ROBERTS’ REQUEST TO REZONE FROM C-G TO A-1

County Attorney Ledbetter read application Z16-06 Marvin L. Roberts’ request to rezone from C-G to A-1.
This was at one time a flea market and Mr. Roberts now wants to put this property back to be used as a farm rather than a flea market. This comes to the Board of Commissioners from the Planning Commission with their recommendations for approval. Mr. Roberts explained his request for rezoning to the Board. No one signed to speak for or against the application for rezoning.

Commissioner Cunningham made a motion to approve the request for rezoning from C-G to A-1.
Commissioner Sexton seconded the motion and Commissioners Cunningham, Sexton, Gazaway, and Steward voted aye. Motion passed.

APPLICATION #Z16-07 LANIER ROLAND’S REQUEST TO REZONE FROM A-1 TO R-1

County Attorney Ledbetter read application Z16-07, Lanier Roland’s request to rezone from A-1 to R-1. This comes to the Board of Commissioners from the Planning Commission with their recommendations for approval. Mr. Terry Brumlow, representing the applicant, spoke to the Board concerning the rezoning.

Commissioner Gazaway made a motion to approve the request for rezoning from A-1 to R-1. Commissioner Cunningham seconded the motion and Commissioners Gazaway, Cunningham, Sexton, and Steward voted aye. Motion passed.

Commissioner Cunningham made a motion to close the public hearing for zoning. Commissioner Gazaway seconded the motion and Commissioners Cunningham, Gazaway, Sexton, and Steward voted aye. Motion passed, public hearing closed.

CONSIDERATION OF UNFINISHED BUSINESS

None

CONSIDERATION OF NEW BUSINESS

PROCLAMATION FOR NATIONAL TELECOMMUNICATOR WEEK APRIL 10-16

Commissioner Kevin Cunningham read the proclamation and presented it to Director of E-911 Ms. Debbie Vance and two of her E-911 Communication Officers. Ms. Vance invited the Board and encouraged everyone to drop by the 911 Center for an open house on April 12 from 9:00 am to 11:00 am. to view the 911 Center and see what your tax dollars pay for and see the Communication Officers in action. Board Chairman, Becky Hood congratulated the E-911 Department and thanked them for the work that they do for Gordon County.

PETITION TO SELL GUYWIRE EASEMENT TO TVA

County Attorney Ledbetter advised the Board that this item is a request for an easement where TVA can install a guy wire and permission to maintain the trees around it. The City of Calhoun owns this property jointly with Gordon County.

Commissioner Cunningham made a motion to approve the easement to TVA. Commissioner Steward seconded the motion and Commissioners Cunningham, Steward, Gazaway and Sexton voted aye. Motion passed.

APPROVAL OF DONATING A VEHICLE TO GEORGIA NORTHWESTERN TECHNICAL POLICE ACADEMY CLASS A 2008 FORD CROWN VICTORIA VIN#2FAFP71V48X164198

Chairman Hood advised that this is a request from Georgia Northwestern Technical for Gordon County to donate a 2008 Ford Crown Victoria to the Police Academy Class. The vehicle was turned in by the Sheriff’s Department and declared surplus at a previous Board meeting.

Commissioner Gazaway made a motion to approve the donation to Georgia Northwestern. Commissioner Sexton seconded the motion and Commissioners Gazaway, Sexton, Cunningham, and Steward voted aye. Motion passed.

ADJOURNMENT

Commissioner Cunningham made a motion to adjourn the meeting. Commissioner Gazaway seconded the motion and all voted aye. There being no further business, the meeting was adjourned at 6:27 p.m.
