4/11/2011 Planning & Zoning Commission Minutes
The Gordon County Planning & Zoning Commission held a Public Hearing on Monday, April 11, 2011 at 7:00 p.m. in the Conference Room of the Gordon County Administration Building for the purpose of hearing variance and zoning change requests.
Chairman Talley called the meeting to order and advised all present of the sign-up sheets available for those who wish to address the Planning Commission on any of the zoning or variance change applications.
APPROVAL OF MINUTES
A motion was made by Brad Rains to approve the minutes of the previous meeting of February 14, 2011. Ron Free seconded the motion. All voted aye. The minutes were approved as written.
VARIANCE APPLICATION #V11-01, RENITH HENDRIX (APPLICANT: RANDELL SCOTT HENDRIX)
Chairman Talley read variance application #V11-01, Renith Hendrix (applicant: Randell Scott Hendrix) requesting a variance for 1.033 acres located at 362 Pittman Road, Ranger to reduce minimum lot size from 2 acres to 1.033 acres for family ties and also reduce the access drive from 25 feet wide to 20 feet wide. Renith Hendrix along with his son, Randell Scott Hendrix represented the variance request explaining that of the original 6.033 acres this was the only suitable location to sub-divide off because of the terrain of the land. Additionally, they would like to keep the larger tract at 5 acres to leave as an A-1 zoning since the property is fenced with cattle, and allow his son to build on the balance of 1.033 acres. The reason they are requesting the variance to reduce the drive was because of the placement of the septic system and field lines. Planning Commission Member, Ron Free advised that the access easement be documented on the deed. All adjoining property owners had been notified.
Paige Hatley, with MACTEC acting as the Planning Consultant for Gordon County, recommends the following actions for the requested variances identified in Application #V11-01: 1- Approval of the variance from the minimum lot area requirement; and 2- Denial of the variance from the minimum access requirement. The requirements of Section 4.04.04(C) (3) (b) of the ULDC shall apply, including a 25 foot wide access easement and a minimum 12 foot wide driveway. Randy Rule made the motion to approve the 1st part of the request to allow reduction of the lot size from 2 acres to 1.033 acres and deny the 2nd part therefore applicant must comply with the county requirement for a 25 foot wide access easement and a minimum 12 foot driveway. Ron Free seconded the motion. Ricky Smith was opposed to the motion. The vote was 3-1 to allow the reduction of the lot size from 2 acres to 1.0333 but the applicant must comply with county codes in regards to the driveway. The thirty- (30) day appeal period was explained.
ADDITIONAL BUSINESS
Ursula Desrosier, Zoning Administrator for Gordon County, informed the Planning Commission in regards to the ordinance enforcement problems that was discussed at the last meeting. Ms. Desrosier had spoken with the County Attorney, Suzanne Smith, and Ms. Smith had advised her that the Planning Commission could certainly request from the Board of Commissioners to be granted some relief to the lack of enforcement concerning stipulations that property owners were not complying with. Ron Free made the motion and suggested that the Planning Commission Chairman and Vice Chairman should go before the Board of Commissioners and petition to allow another employee the responsibility to follow up on properties in the county that are not complying with county codes. Ricky Smith seconded the motion. All voted aye. Chairman Talley and Vice-Chairman Rains will plan to speak the Board of Commissioners at the next meeting of April 19th, 2011.
There being no additional business, Randy Rule made the motion to adjourn. Brad Rains seconded the motion. All voted aye. The meeting was adjourned at 7:30 p.m.
