4/12/2010 Planning & Zoning Commission Minutes

The Gordon County Planning & Zoning Commission held a Public Hearing on Monday, April 12, 2010 at 7:00 p.m. in the Conference Room of the Gordon County Administration Building for the purpose of hearing variance and zoning change requests. Chairman Talley called the meeting to order and advised all present of the sign-up sheets available for those who wish to address the Planning Commission on any of the zoning or variance change applications.

APPROVAL OF MINUTES
A motion was made by Ricky Smith to approve the minutes of the previous meeting of March 8, 2010. Brad Rains seconded the motion. All voted aye. The minutes were approved as written.

VARIANCE APPLICATION #V10-03 & V10-04, BETTY S. PAYNE
Chairman Talley read variance application #V10-03, requesting to reduce building setback line requirements and #V10-04, requesting to increase structure size. The applications were for .81 acres owned by Betty S. Payne at 442 Fields Ferry Drive, Calhoun. Terry Brumlow, a local attorney, represented both requests explaining that Ms. Payne’s daughter had recently moved back in with her 2 small children and they had enclosed their existing garage for extra room for the children. Mr. Payne is an avid fisherman and has a boat but because of the covenants at Fields Ferry, a boat has to be kept in a garage. The Payne’s want to build a detached garage of 2000 square feet rather than the 1200 square foot limit and they will have to place it on their lot 2 feet from property line rather than the required 5 foot setback. All adjoining property owners had been notified. Ursula Desrosier, acting on behalf of MACTEC, the Planning Consultant for Gordon County, recommended that the variance request #V10-03 and #V10-04, be denied due to lack of evidence of a hardship. Mr. Brumlow explained that Ms. Payne had tried to purchase additional property from the City of Calhoun and the adjoining lot, but subdividing lots are forbidden because of the covenants at Fields Ferry. On variance application #V10-03, Ricky Smith made the motion to approve the variance as requested, to reduce the setback requirements on the back and side to within 2 feet from the adjoining property line. Brad Rains seconded the motion. All voted aye. The variance was approved. The thirty- (30) day appeal period was explained. On variance application #V10-04, Brad Rains made the motion to approve the variance as requested, to allow construction of a 2000 square foot detached garage to store vehicles and a boat from view as required by the subdivision covenants from the allowed 1200 square foot limit. Ricky Smith seconded the motion. All voted aye. The variance was approved. The thirty- (30) day appeal period was explained.

ADDITIONAL BUSINESS
There being no additional business, Brad Rains made the motion to adjourn. Ricky Smith seconded the motion. All voted aye. The meeting was adjourned at 7:22 p.m.
