PLANNING and ZONING COMMISSION
PUBLIC HEARING MINUTES
JULY 12, 2021


The Gordon County Planning Commission held a Public Hearing on Monday, July 12, 2021 at 6:00 p.m. in Conference Room of the Gordon County Administration Building for the purpose of hearing variance and zoning change requests.

Members present were:
Jerry Lovelace, Eddie Smith, Nathan Serritt, and Sabrina Poole

Jerry Lovelace called the meeting to order and advised all present of the sign-up sheets available for those who wish to address the Planning Commission on any of the zoning or variance change applications.

APPROVAL OF MINUTES

A motion was made by Eddie Smith to approve the minutes of the previous meeting of June 14, 2021. Nathan Serritt seconded the motion. All voted aye. The minutes were approved as written.

REZONING APPLICATION #Z21-10, J. TOM & ERICA DOOLEY

Vice-Chairman Lovelace read rezoning application #Z21-10, J. Tom and Erica Dooley. Ursula Richardson, Zoning Administrator announced to the Planning Commission that this application had been withdrawn.

REZONING APPLICATION #Z21-13, TOA QUOC NGUYEN, (applicant); SPRINGBANK, LLC (owner)

Vice-Chairman Lovelace read rezoning application #Z21-13, Toa Quoc Nguyen (appl.), Springbank, LLC (owner). Ursula Richardson, Zoning Administrator announced that the applicant request to table the application until the August 9, 2021 meeting to have more time to get the studies that were requested last month at the meeting. Nathan Serritt made the motion to table the request until the August 9, 2021 meeting. Eddie Smith seconded the motion. All voted aye. The application was tabled until the August 9, 2021 meeting.

REZONING APPLICATION #Z21-14, D & D INVESTMENT PROPERTIES, LLC

Vice-Chairman Lovelace read rezoning application #Z21-14, D & D Investment Properties, LLC. Ursula Richardson, Zoning Administrator announced to the Planning Commission that this application had been withdrawn.

REZONING APPLICATION #Z21-15, LEONIDAS EFSTATHIOU (appl.) LEO-NIDAS ENTERPRISES, INC. (owner)

Vice –Chairman Lovelace read rezoning application #Z21-15, Leonidas Efstathiou (appl.), Leo-Nidas Enterprises, Inc. (owner), requesting to rezone .78 acres located at 4952 Fairmount Hwy., Calhoun from CC to R-1. Mr. Efstathiou represented the request stating he would like to use this structure as a dwelling again instead of an office and needs to bring it back into compliance with the ULDC. All adjoining property owners had been notified.

Nathan Serritt made the motion to approve the rezoning application identified as #Z21-15 from C-C to R-1. Eddie Smith seconded the motion. Sabrina Poole abstained from the vote. Vice-Chairman Lovelace voted with the motion. The vote was 3-0 to approve. The recommendation for approval was sent to the Board of Commissioners.

VARIANCE APPLICATION #V21-12 & REZONING APPLICATION #Z21-16, STREAM REALTY ACQUISITION (appl.), THE KING FAMILY REVOCABLE LIVING TRUST/KENT & KAREN KING, AS TRUSTEES (owner)

Vice-Chairman Lovelace read variance application #V21-12 and rezoning application #Z21-16, Stream Realty Acquisition, applicant and The King Family Revocable Living Trust/Kent and Karen King, as Trustees, owner for a 38.92 acre tract located at 3092 U.S. Hwy. 41, South, Calhoun. Scott Jones represented the request stating that the variance request is to reduce the buffer strip from 100 feet to 20 feet on the North and West sides of the property. The rezoning request is to rezone this property from A-1 to I-1 to build industrial building for a major development for local industry. All adjoining property owners had been notified.

On variance application #V21-12, Eddie Smith made the motion to approve the variance with the stipulation that the west side stay at the regulated 50 feet but the north side be reduced to 50 feet buffer however, leaving the vegetated area in tact surrounding the property. Nathan Serritt seconded the motion. All voted aye. The variance was granted as stipulated. The thirty-(30) day appeal period was explained.

On rezoning application #Z21-16, Nathan Serritt made the motion to approve the rezoning request from A-1 to I-1 with the conditions that all applicable state and local regulations shall be complied with, including but not limited to Gordon County appearance standards for structures in industrial zoning districts, landscaping and buffer requirements and sign requirements. Sabrina Poole seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.

VARIANCE APPLICATION #V21-13 & REZONING APPLICATION #Z21-18, OWR, LLC (appl.) CON-ONAULA FARMS, LLLP (owner)

Vice-Chairman Lovelace read variance application #V21-13 and rezoning application #Z21-18, OWR, LLC, applicant and Con-onaula Farms, LLLP, owner for a 38 acre tract located on Trimble Hollow Rd., Adairsville. Terry Brumlow, a local attorney, represented the request stating that the variance request is to reduce the buffer strip from 250 feet to 20 feet on the North and East boundaries of the property. The rezoning request is to rezone this property from A-1 to I-2. Mr. Brumlow also added that the developer will be building a new county road into the property. All adjoining property owners had been notified.

On variance application #V21-13, Eddie Smith made the motion to approve the variance as requested to reduce the county buffer requirements from 250 feet to 20 feet on the North and East boundaries of the property with the stipulation to satisfy the construction of the new county road. Sabrina Poole seconded the motion. All voted aye. The variance was granted. The thirty-(30) day appeal period was explained.

On rezoning application #Z21-18, Eddie Smith made the motion to approve the rezoning request from A-1 to I-2. Nathan Serritt seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.

ADDITIONAL BUSINESS

There being no additional business, Eddie Smith made the motion to adjourn. Sabrina Poole seconded the motion. All voted aye. The meeting was adjourned at 6:22 p.m.
