The Gordon County Board of Commissioners held their Regular Meeting on July 20, 2021, beginning at 6:00 p.m. in the conference room of the Administration Building.

Chairman Hood called the meeting to order.

APPROVAL OF MINUTES

Chairman Hood asked if there are any additions, omissions, or deletions to the Minutes for the Work Session and Regular Meeting of July 6, 2021. Commissioner Owens made a motion to approve the Minutes. Commissioner Potts seconded the motion and Commissioners Owens, Potts, Steward, and Cunningham voted aye. Motion passed.

ADMINISTRATOR’S REPORT

Administrator Ledbetter read the Administrator’s report. (copy attached).

COMMISSIONERS’ REPORT

Commissioner Potts reported that he and Craig Sparks had met with Dr. Fraker regarding ball fields. He attended the Board of Health meeting, CERT training, Airport Authority meeting and also met with Representative Matt Barton. Commissioner Cunningham reported that he met with two citizens that had road complaints, also met with Administrator Ledbetter a couple of times.

Commissioner Cunningham made a motion to open the Public Hearing for Zoning. Commissioner Potts seconded the motion and all voted aye.

PUBLIC HEARING FOR ZONING

Zoning Application #Z21-15 Leonidas Efstathiou’s Request to Rezone from CC Crossroad Commercial to R-1 Low Density Residential
Administrator Ledbetter read the rezoning application for Leonidas Efstathiou requesting to rezone from CC Crossroad Commercial to R-1 Low Density Residential. This comes to the Board of Commissioners from the Planning Commission with their recommendations for approval. Mr. Efstathiou spoke to the Board and explained the rezoning request. He wants to use the structure as a home again instead of an office.

Commissioner Steward made a motion to approve the rezoning from CC Crossroad Commercial to R-1 Low Density Residential. Commissioner Potts seconded the motion and Commissioners Cunningham, Potts, Steward, and Owens voted aye. Motion passed.

Zoning Application #Z21-16 Stream Realty Acquisition, LLC’s Request to Rezone from A-1 to
I-1 Light Industrial
Administrator Ledbetter read the application for rezoning for Stream Realty Acquisition, LLC’s request to rezone from A-1 to I-1 light industrial. This is the old Patty’s Truck Stop location. This comes to the Board of Commissioners from the Planning Commission with their recommendations for approval with stipulations that all applicable state and local regulations shall be complied with, including but not limited to Gordon County appearance standards for structures in industrial zoning districts, landscaping and buffer requirements and sign requirements. Mr. Scott Jones spoke to the Board to explain the rezoning request. He explained that the rezoning is for an industrial building for development for local industry. The buffer will be 300 to 400 feet on the backside buffer. Mr. Roy Chadwick signed up to speak and said he was not against the rezoning, his concern is with traffic and he wanted to know if the traffic would come out on Old Dixie Highway. Mr. James said that they have no plans to come out on Old Dixie Highway, both their exits are coming out on 41 Highway.

Commissioner Potts made a motion to approve the rezoning from A-1 to I-1 Light Industrial with the stipulations as read by the Administrator. Commissioner Cunningham seconded the motion and Commissioners Steward, Owens, Potts, and Cunningham voted aye. Motion passed.

Zoning Application #Z21-18 OWR, LLC’s Request to Rezone from A-1 to I-2 Heavy Industrial
Administrator Ledbetter read the application for rezoning for OWR, LLC’s request to rezone from A-1 to I-2 heavy industrial. This is the last of the Con-onaula property. This comes to the Board of Commissioners from the Planning Commission with their recommendations for approval. The owner of the property is Con-onaula Farms. Mr. John Robins with Brumlow Law Firm, representing the applicant spoke to the Board to explain the rezoning and explained that the developer will build a new county road to the property.

Commissioner Cunningham made a motion to approve the rezoning request from A-1 to I-2 heavy industrial. Commissioner Owens seconded the motion and Commissioners Cunningham, Owens, Steward, and Potts voted aye. Motion passed.

Commissioner Potts made a motion to close the Public Hearing for zoning. Commissioner Owens seconded the motion and Commissioners Potts, Owens, Cunningham, and Steward voted aye. Motion approved.

CONSIDERATION OF UNFINISHED BUSINESS

None

CONSIDERATION OF NEW BUSINESS

BUDGET AMENDMENT FOR THE GEORGIA DEPARTMENT OF TRANSPORTATION SAFETY GRANT FOR $175,000
Administrator Ledbetter advised that this is a budget amendment to receive the $175,000 from the Georgia Department of Transportation for the Safety Grant. This is additional LMIG money.

Commissioner Potts made a motion to approve the Budget Amendment for $175,000 to receive the grant from the Georgia DOT. Commissioner Owens seconded the motion and Commissioners Steward, Cunningham, Potts, and Owens voted aye. Motion passed.

RE-APPOINTMENT OF LANE BENNETT TO THE HIGHLAND RIVERS BOARD OF DIRECTORS FOR A THREE-YEAR TERM ENDING 6/30/2024
Administrator Ledbetter advised this is a re-appointment to the Highland Rivers Board of Directors for Lane Bennett for a three-year term ending on 6/30/2024.

Commissioner Steward made a motion to approve the re-appointment of Lane Bennett to the Highland Rivers Board of Directors. Commissioner Cunningham seconded the motion and Commissioners Steward, Potts, Cunningham, and Owens voted aye. Motion passed.

QUIT CLAIM DEED TO CARLTON HYDE FOR ABANDONED PORTION OF OLD CORINTH ROAD
Administrator Ledbetter advised that this is a quit claim deed presented to us by Mr. Charles Williams, lawyer for Carlton Hyde. Corinth Road was moved back in the 1960’s and no one can find where the old roadbed has been abandoned. There is a piece of the old roadbed there that Gordon County no longer uses or needs and it is affecting Carlton Hyde’s title. This is a quit claim deed that will solve that title.

Commissioner Owens made a motion to approve the Quit Claim deed to Carlton Hyde for the abandoned portion of Old Corinth Road. Commissioner Potts seconded the motion and Commissioners Potts, Owens, Steward, and Cunningham voted aye. Motion passed.

CONSIDERATION OF ADDITIONAL ARCHITECT FEES FOR THIRD FLOOR OF MAIN COURTHOUSE
Administrator Ledbetter advised that this is for Board consideration of additional architect fees for the third floor of the main courthouse due to moving elections to the first floor and Probate to the third floor. We have been in discussions with the Probate Court that is going on the third floor and we had to make some adjustments to suit their storage needs as required by Georgia law for keeping the records appropriately. The redraw fee is $49,141.56 and will be for new walls and electricity. We are saving whatever it would have cost us to build a new election facility.

Commissioner Potts made a motion to approve the additional architect fees for the third floor of the main courthouse. Commissioner Cunningham seconded the motion and Commissioners Potts, Owens, Steward, and Cunningham voted aye. Motion passed.

ADJOURNMENT

Commissioner Cunningham made a motion to adjourn the Regular Meeting. Commissioner Potts seconded the motion and all voted aye.

There being no further business, the meeting adjourned at 6:44 p.m.
