REGULAR MEETING MINUTES
AUGUST 21, 2012


The Gordon County Board of Commissioners held their Regular Meeting on Tuesday, August 21, 2012, at 6:00 p.m. in the Conference Room of the Administration Building.

Chairman Bailey called the meeting to order.

Chairman Bailey welcomed everyone to the meeting.

APPROVAL OF MINUTES

Chairman Bailey asked if there were any additions, omissions, or deletions to the Minutes for the Work Session August 7, 2012, and the Regular Meeting August 7, 2012. Commissioner Long made a motion to approve the minutes. Commissioner Steward seconded the motion and all voted aye. Minutes approved.

CONSIDERATION OF OLD BUSINESS

  • MALT BEVERAGE WINE & LIQUOR ORDINANCE – 2nd Reading
    County Attorney Smith advised the Board that this is the second reading of the amended Malt Beverage Wine & Liquor Ordinance. This is an amendment to the ordinance, at the request of staff, concerning the provision that required a 15-day period for applying for a Special Event Permit before the actual event. Due to pre-planning for a special event, the ordinance should be amended to require applying for a permit at least 30 days before the event in order to allow time for the application to be processed and to give the applicant time to advertise and possibly sell tickets, etc. This ordinance is now ready for Board consideration for adoption.Commissioner Long made a motion to approve the amendment to the Malt Beverage Wine & Liquor Ordinance. Commissioner Steward seconded the motion and Commissioners Long, Steward, and Hood voted aye. Motion passed.
CONSIDERATION OF NEW BUSINESS
  • CONSIDERATION OF APPROVAL OF A LOCAL 2% ENERGY EXCISE TAX USED IN MANUFACTURING
    County Administrator Dowling advised that this is for Board approval of a local 2% energy excise tax used in manufacturing. The State of Georgia is preparing to phase out their 6% tax for energy used in manufacturing beginning January 1, 2013 over a four-year period. The sales tax elimination will affect all Georgia counties. The State law allows us to recoup the county’s portion of that 6% loss. Counties and cities can impose a local excise tax of 2% on the energy used in manufacturing at the same rate as the phase out period. State law requires, by September 1st, that the Board of Commissioners write a letter to all the cities asking for a meeting to confer and decide if the cities and the county want to impose the 2% option excise tax. After the meeting, an intergovernmental agreement would be prepared and signed by all the cities who will participate and then an ordinance would be prepared by the county imposing the sales tax.County Attorney advised the Board that if the Board were to adopt this excise tax, it would have to be applied countywide, or citywide if a city. No exemptions would apply.

    Chairman Bailey asked for a motion for approval of moving forward with a meeting to discuss the beginning of the process of imposing a local 2% energy excise tax used in manufacturing. Commissioner Long made a motion to move forward with the process as described. Commissioner Hood seconded the motion and Commissioners Long, Steward, and Hood voted aye. Motion passed.

  • BID AWARD FOR A 2013 FORD INTERCEPTOR UTILITY VEHICLE FOR THE FIRE DEPARTMENT 

    County Administrator Dowling advised that this is bid award for a Ford Interceptor utility vehicle for the Fire Department. Gordon County solicited for bids and five dealers responded with sealed bids. Staff reviewed the bids and the recommendation is to award the bid to Prater Ford as the most responsive bidder for this vehicle with a bid of $25,795. Funding for this vehicle comes from the Fire Department’s capital outlay budget.Commissioner Long made a motion to award the bid to Prater Ford. Commissioner Steward seconded the motion and Commissioners Long, Steward, and Hood voted aye. Motion passed.

  • APPLICATION FOR MALT BEVERAGE WINE & LIQUOR LICENSE FOR CALHOUN ELKS 

    County Attorney Smith advised the Board that this is an application for a Malt Beverage Wine & Liquor license for Calhoun Elks under the new ordinance allowing for the sale of distilled spirits for beverage purposes by the drink for consumption on the premises. The Calhoun Elks currently holds a consumption on the premises license and this would allow for the sale of liquor by the drink. All paperwork is in order.Commissioner Long made a motion to approve the application for the Calhoun Elks. Commissioner Hood seconded the motion and Commissioners Long, Hood, and Steward voted aye. Motion passed.

  • APPLICATION FOR MALT BEVERAGE WINE & LIQUOR LICENSE FOR FAIRMOUNT AMERICAN LEGION 

    County Attorney Smith advised the Board that this is an application for a Malt Beverage Wine & Liquor license for Fairmount American Legion under the new ordinance allowing for the sale of distilled spirits for beverage purposes by the drink for consumption on the premises. Fairmount American Legion currently holds a consumption on the premises license and this would allow for the sale of liquor by the drink. All paperwork is in order.Commissioner Hood made a motion to approve the application for the Fairmount American Legion. Commissioner Steward seconded the motion and Commissioners Hood, Steward, and Long voted aye. Motion passed.

ADJOURNMENT

Commissioner Hood made a motion to adjourn the meeting. Commissioner Steward seconded the motion and all voted aye. There being no further business, the meeting was adjourned at 6:20 p.m.
