GORDON COUNTY
PLANNING and ZONING COMMISSION MEETING
OCTOBER 17, 2022


The Gordon County Planning Commission held a Public Hearing on Monday, October 17, 2022 at 6:00 p.m. at the Gem Theater, 114 N. Wall St., Calhoun for the purpose of hearing variance and zoning change requests.

Members present were:  Randy Rule, Tommy Hibberts, Jerry Lovelace, and Nathan Serritt

Randy Rule called the meeting to order and advised all present of the sign-up sheets available for those who wish to address the Planning Commission on any of the zoning or variance change applications.  The Planning Commission welcomed new member Tommy Hibberts to the Commission.

APPROVAL OF MINUTES

A motion was made by Jerry Lovelace to approve the minutes of the previous meeting of       September 12, 2022.  Nathan Serritt seconded the motion.  All voted aye.  The minutes were approved as written.

VARIANCE APPLICATION #V22-15 & REZONING APPLICATION #Z22-17,  CHARLES & CONNIE MAURO

Chairman Rule read variance application #V22-15 and rezoning application #Z22-17,  Charles and Connie Mauro.  The property is a 1.74 acre tract located at 146 Hammond Road, Calhoun.  Mr. Mauro represented the requests explaining that he would like to subdivide his existing home and deed the back portion to his son for a home site and he needs the variance to reduce the county road frontage from 75 feet to 30 feet and to rezone both lots from A-1 to R-1.  All adjoining property owners had been notified.

On variance application #V22-15, Nathan Serritt made the motion to approve the variance to allow reduction of road frontage from 75 feet to 30 feet, with the stipulation that the issues with Environmental Health are resolved.  Jerry Lovelace seconded the motion.  All voted aye.  The variance was granted.  The thirty (30) day appeal period was explained.

On rezoning application #Z22-17, Jerry Lovelace made the motion to approve the rezoning request from A-1 to R-1, with the stipulation that it meets the issues with Environmental Health.  Nathan Serritt seconded the motion.  All voted aye.  The recommendation for approval was sent to the Board of Commissioners.

REZONING APPLICATION #Z22-18, OOTHCALOOGA RPTG TK LLC (owner), CHI/ACQUISITIONS, L.P. (appl.)

Chairman Rule read rezoning application #Z22-18, Oothcalooga RPTG TK LLC (owner), CHI/Acquisitions, L.P. (appl.), requesting to rezone a 90 acre tract located at 448 Spring Hill Road and Old Dixie Hwy., Adairsville from A-1 to I-1.  Terry Brumlow, a local attorney,  represented the request for the applicant explaining that the property will be purchased by the applicant for construction of one industrial building, employee parking, truck courts, and all associated infrastructure.  Also the proposed entrance will be constructed utilizing Old Dixie Hwy. and LG Drive and will not utilize Spring Hill Road.  Mr. Brumlow added that they would be running sewer from Old Dixie Hwy.  William Prueter spoke in opposition to the rezoning stating that these warehouse developments have gone too far and are a threat to our way of life and the air we breath.  Andy Bailie spoke with concerns of fire protection, flood zone, and also questioned why was there not a DRI and traffic study.  Mr. Brumlow stated that the DRI would be complete next week giving enough time for the Board of Commissioners to review before the November 1, 2022 final hearing.  All adjoining property owners had been notified.

Jerry Lovelace made the motion to approve the rezoning application identified as #Z22-18 from A-1 to I-1.  Nathan Serritt seconded the motion.  All voted aye.  The recommendation for approval was sent to the Board of Commissioners.

ADDITIONAL BUSINESS   

There being no additional business, Nathan Serritt made the motion to adjourn.  Jerry Lovelace seconded the motion.  All voted aye.  The meeting was adjourned at 6:39 p.m.
