PLANNING and ZONING COMMISSION
PUBLIC HEARING
NOVEMBER 8, 2021
The Gordon County Planning Commission held a Public Hearing on Monday, November 8, 2021 at 6:00 p.m. in the Conference Room of the Gordon County Administration Building for the purpose of hearing variance and zoning change requests.
Members present were:
Randy Rule, Eddie Smith, Jerry Lovelace, Nathan Serritt, and Sabrina Poole
Randy Rule called the meeting to order and advised all present of the sign-up sheets available for those who wish to address the Planning Commission on any of the zoning or variance change applications.
APPROVAL OF MINUTES
A motion was made by Jerry Lovelace to approve the minutes of the previous meeting of October 11, 2021. Sabrina Poole seconded the motion. All voted aye. The minutes were approved as written.
VARIANCE APPLICATION #V21-18 & REZONING APPLICATION #Z21-29, VARIANCE APPLICATION #V21-19 & REZONING APPLICATION #Z21-30, INLIGHT REAL ESTATE ACQUISITIONS, LLC (appl) D&D INVESTMENT PROPERTIES, LLC (owner) (Tabled from October 11, 2021)
Chairman Rule read variance application #V21-18 and rezoning application #Z21-29, variance application #V21-19 and zoning application #Z21-30, InLight Real Estate Acquisitions, LLC (appl) and D&D Investment Properties, LLC (owner). Terry Brumlow, a local attorney, represented the requests and asked the Planning Commission to table these request until the December 13, 2021 meeting. On variance application #V21-18, Jerry Lovelace made the motion to table the request until the December 13, 2021 meeting. Nathan Serritt seconded the motion. All voted aye. On rezoning application #Z21-29, Eddie Smith made the motion to table the request until the December 13, 2021 meeting. Jerry Lovelace seconded the motion. All voted aye. On variance application #V21-19, Eddie Smith made the motion to table the request until the December 13, 2021 meeting. Sabrina Poole seconded the motion. All voted aye. On rezoning application #Z21-30, Sabrina Poole made the motion to table the request until the December 13, 2021 meeting. Jerry Lovelace seconded the motion. All voted aye. All the applications were tabled until the December 13, 2021 meeting.
VARIANCE APPLICATION #V21-20 & REZONING APPLICATION #Z21-31, DAVID FOWLER
Chairman Rule read variance application #V21-20 and rezoning application #Z21-31, David Fowler, for a 1.96 acre tract located at 3514 Dews Pond Road, Calhoun. Mr. Fowler represented the request explaining that he would like to reduce the county road frontage from 75 feet to 25 feet on the back lot and would like to rezone this property from A-1 to R-1 to subdivide the property and sell the existing single family home then build a single family home on the back tract. All adjoining property owners had been notified.
On variance application #V21-20, Nathan Serritt made the motion to approve the variance and allow construction of a new home with only 25 feet of county road frontage. Jerry Lovelace seconded the motion. All voted aye. The variance was granted. The thirty-(30) day appeal period was explained. On rezoning application #Z21-31, Nathan Serritt made the motion to approve the rezoning from A-1 to R-1on the 1.96 acre tract. Sabrina Poole seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.
REZONING APPLICATION #Z21-32, KEVIN OSBOURNE (appl.) SUNBELT HOLDING, LLC (owner)
Chairman Rule read rezoning application #Z21-32, Kevin Osbourne (appl.) and Sunbelt Holding, LLC (owner), requesting to rezone a 1.59 acre tract located at 572 Millers Ferry Rd., Adairsville from R-1 to R-6. Mr. Osbourne explained that he would like to renovate a double wide mobile home, clean up the lot and sell the property. The home will be renovated to like new condition prior to sale. Area and adjoining property owners Theresa Barger and Leon Holloway had concerns about setting precedence for additional mobile homes in the area and also the floodplain issue with this lot. All adjoining property owners had been notified.
Sabrina Poole made the motion to approve the rezoning application identified as #Z21-32 from R-1 to R-6. Jerry Lovelace seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.
REZONING APPLICATION #Z21-33, STEVEN WARE (appl.) C. YVETTE DICKENS (owner)
Chairman Rule read rezoning application #Z21-33, Steven Ware (appl.) and C. Yvette Dickens (owner), requesting to rezone a 6 acre tract located at 5247 Roland Hayes Pkwy., Calhoun from A-1 to RA-1. Mr. Ware explained that he would like to renovate the existing farmhouse and subdivide off 2 additional tracts to convert into three single family dwellings. Area property owner Anthony Boone had concerns about the plans for the property. All adjoining property owners had been notified.
Jerry Lovelace made the motion to approve the rezoning application identified as #Z21-33 from A-1 to RA-1, with the stipulations that all requirements are met from Environmental Health, Building Inspector, and Georgia D.O.T. Nathan Serritt seconded the motion. All voted aye. The recommendation for approval was sent to the Board of Commissioners.
VARIANCE APPLICATION #V21-21, RONALD BALLIEW
Chairman Rule read variance application #V21-21, Ronald Balliew requesting a variance for a 9.858 acre tract located at 1174 Dempsey Loop Road, SE, Adairsville. Mr. Balliew represented the request explaining that he would like to build an 18 x 29 storage shed 7 feet from the adjoining property line, therefore asking for a 13 foot variance. All adjoining property owners had been notified.
Eddie Smith made the motion to approve the variance and allow construction of storage shed 7 feet from side property line and grant the 13 foot variance. Nathan Serritt seconded the motion. All voted aye. The variance was granted. The thirty-(30) day appeal period was explained.
REZONING APPLICATION #Z21-34, INDUSTRIAL VI ENTERPRISES, LLC (appl.) JOHNNIE DOBSON AND LAURA DOBSON – CO-EXECUTORS FOR THE ESTATE OF MELVIN DOBSON (owner)
Chairman Rule read rezoning application #Z21-34, Industrial VI Enterprises, LLC (appl.) and Johnnie Dobson and Laura Dobson – co-executors for the estate of Melvin Dobson (owner), requesting to rezone a 76.17 acre tract located South of the intersection of Union Grove Road and Hwy. 53, Adairsville from A-1 to I-1. William Valentine with Industrial VI Enterprises, LLC represented the request and stated that they are working through the requirements from the City of Calhoun and the Georgia D.O.T. and still does not have the DRI. Adjoining property owner Karen Capehart questioned what would be in the proposed building and Charles Brent Silvers wanted to let the Planning Commission know that he didn’t receive notice. Chairman Rule stated that the Planning Commission would like to see the DRI before making a recommendation to the Board of Commissioners. All adjoining property owners had been notified.
Nathan Serritt made the motion to table the request until the December 13, 2021 meeting. Jerry Lovelace seconded the motion. All voted aye. The rezoning request was tabled until the December 13, 2021 meeting.
ADDITIONAL BUSINESS
There being no additional business, Jerry Lovelace made the motion to adjourn. Nathan Serritt seconded the motion. All voted aye. The meeting was adjourned at 6:54 p.m.
