12/13/2010 Planning & Zoning Commission Minutes

The Gordon County Planning & Zoning Commission held a Public Hearing on Monday, December 13, 2010 at 7:00 p.m. in the Conference Room of the Gordon County Administration Building for the purpose of hearing variance and zoning change requests. Chairman Talley called the meeting to order and advised all present of the sign-up sheets available for those who wish to address the Planning Commission on any of the zoning or variance change applications.

APPROVAL OF MINUTES
A motion was made by Brad Rains to approve the minutes of the previous meeting of September 13, 2010. Ron Free seconded the motion. All voted aye. The minutes were approved as written.

VARIANCE APPLICATION #V10-05, MATT HIBBERTS & MARK MOMON
Chairman Talley read variance application #V10-05, Matt Hibberts and Mark Momon requesting a variance on .46 acres located at 100 Stones Loop, Calhoun for the purpose of constructing a new office structure 10 feet from the back and west side of the property line, instead of the required 25 foot buffer. Mr. Hibberts represented the variance request explaining that they would like to be permitted to expand the existing business of Momon Construction with a detached 3000 square foot office structure and be only 10 feet from the rear and west side. All surrounding property is being used for commercial uses and would like to keep the building in line with their existing business. All adjoining property owners had been notified. Paige Hatley, with MACTEC acting as the Planning Consultant for Gordon County, stated that the addition of a second detached building constitutes as a group project. Section 9.02.03(D) of the ULDC defines a group project as “two (2) or more commercial, industrial, educational, medical, religious, or civic buildings to be constructed on a plot of land two (2) acres or more…” The subject property is less than the required minimum lot size, which will require the acquisition of additional property or a modified proposal that will result in the expansion of the existing building rather that construction of another stand-alone building in order to be in compliance with the ULDC. Additionally, the application as proposed would require a variance from the ULDC standards for buffer areas. Table 4.07.06(C) states that a 25 feet minimum buffer between commercial zoning district and the A-1 zoning district is required. Properties adjacent to the subject property are zoned A-1. Therefore, MACTEC recommends the application be tabled to allow the applicant to modify the application as follows: 1 – Provide the desired 3000 square feet of office space in a manner that is consistent with Section 9.02.03(D) Group projects; and 2 -Comply with or request a variance from the ULDC standards for buffer areas, Table 4.07.06(C). After discussion between the applicant, Ms. Hatley with MACTEC, and the Planning Commission Members; Ron Free made the motion to table the variance application to allow the re-advertising and re-wording of the request as suggested by MACTEC. Ricky Smith seconded the motion. All voted aye. The variance application was tabled until the applicants could modify the request.

ADDITIONAL BUSINESS

  • Ron Free wished everyone a Happy Holiday and Chairman Brant Talley expressed his hope that Planning Commission Members Ron Free and Brad Rains would be reappointed by the Board of Commissioners for another term to continue to serve on the Planning Commission.

There being no additional business, Brad Rains made the motion to adjourn. Randy Rule seconded the motion. All voted aye. The meeting was adjourned at 7:32 p.m.
