12/20/11 Regular Session Minutes
The Gordon County Board of Commissioners held their Regular Meeting on Tuesday, December 20, 2011, at 10:00 a.m. in the Conference Room of the Administration Building.
Chairman Bailey called the meeting to order.
INVOCATION AND PLEDGE OF ALLEGIANCE
Invocation was led by Rev. John Allen and the pledge of allegiance was led by Chairman Bailey.

Chairman Bailey welcomed everyone to the meeting.
APPROVAL OF MINUTES
Chairman Bailey asked if there were any additions, omissions, or deletions to the Minutes for the Work Session December 6, 2011 and the Regular Meeting December 6, 2011. Commissioner Steward made a motion to approve the minutes. Commissioner Hood seconded the motion and all voted aye. Minutes approved.

CONSIDERATION OF NEW BUSINESS
- BID AWARD COURTHOUSE ANNEX WALL AND RE-ROOF PROJECT
Administrator Dowling advised the Board that this is a bid award for repairing the courthouse annex wall and re-roof the entire annex. Gordon County solicited for bids and received numerous bids from qualified vendors. The recommendation is to award the bid to Cope Brothers Construction out of Dalton with a bid of $83,263 plus a 10% contingency for a total of $91,500. Commissioner Long made a motion to award the bid to Cope Brothers Construction in the amount of $83,263 plus a 10% contingency for a total of $91,500. Commissioner Steward seconded the motion and Commissioners Long, Steward, Hood and Townsend voted aye. Motion passed.
- APPROVAL OF A PILOT AGREEMENT FOR L G HAUSYS AMERICA, INC.
Administrator Dowling advised the Board that this is for Board approval of a pilot agreement for L G Hausys America, Inc. The attorney for the Development Authority was at our Work Session to explain the pilot agreement; staff recommends approval for the Chairman to execute the document. Commissioner Long made a motion to approve the pilot agreement and authorize the Chairman to sign the agreement. Commissioner Hood seconded the motion and Commissioners Steward, Hood, Townsend, and Long voted aye. Motion passed.
- RESOLUTION ADOPTING THE AMENDMENTS TO THE ULDC
Attorney Smith advised the Board that this is adoption of a resolution concerning the amendments to the ULDC. Numerous amendments to the ULDC were approved last calendar year by the Board. Those amendments are transmitted to Municipal Code to be reprinted into the Code Book for ULDC. Municipal Code has requested that a resolution of transmittal be submitted authorizing them to reprint to the Code Book. Commissioner Steward made a motion to approve the resolution. Commissioner Hood seconded the motion and Commissioners Steward, Hood, Townsend, and Long voted aye. Motion passed.
- MALT BEVERAGE & WINE LICENSE RENEWAL APPLICATION FOR 2012
Attorney Smith advised that this is for Board consideration of approval of the malt beverage and wine license renewals for 2012. All paperwork is in order and recommendation is for approval. Commissioner Long made a motion to approve the renewal application for 2012. Commissioner Hood seconded the motion and Commissioners Long, Hood, Townsend, and Steward voted aye. Motion passed.
- MALT BEVERAGE & WINE LICENSE APPLICATION FOR RALSTONS CORNER|
Attorney Smith advised that this is for Board consideration for approval of a malt beverage and wine license application for Ralstons Corner. This is a transfer of ownership requiring a new application for license. Commissioner Hood made a motion to approve the application for Ralstons Corner. Commissioner Long seconded the motion and Commissioners Long, Townsend, Steward, and Hood voted aye. Motion passed.
- APPROVAL OF THE BALLOT QUESTIONS FOR THE MARCH 6, 2012 ELECTIONS FOR THE SALE OF BEER AND WINE ON SUNDAYS AND THE SALE OF DISTILLED SPIRITS ON SUNDAYS
Question #1 Shall the Board of Commissioners permit and regulate Sunday sales of distilled spirits or alcoholic beverages for beverage purposes by the drink starting July 1, 2012. Attorney Smith advised the Board that this is for Board consideration of a resolution by the Board placing the following question on the March 6th ballot for consideration by all of the voters of Gordon County. The question to be considered, pursuant to this resolution is: Shall the Board of Commissioners of Gordon County permit and regulate Sunday sales of distilled spirits or alcoholic beverages for beverage purposes by the drink starting July 1, 2012. Commissioner Long made a motion to approve the question be put on the March 6th ballot. Commissioner Steward seconded the motion and Commissioners Long, Steward, Townsend, and Hood voted aye. Motion passed.
- Question #2 Shall the Board of Commissioners permit and regulate the package sales by retailers of malt beverages and wine on Sunday between the hours of 12:30 p.m. and 11:30 p.m. starting July 1, 2012 Attorney Smith advised the Board that this is for Board consideration of a resolution by the Board placing the following question on the March 6th ballot for consideration by all of the voters of Gordon County. The question to be considered, pursuant to this resolution is: Shall the Board of Commissioners of Gordon County permit and regulate the package sales by retailers of malt beverages and wine on Sunday between the hours of 12:30 p.m. and 11:30 p.m. starting July 1, 2012. Commissioner Long asked if those times are State statutes. Attorney Smith advised that those times are in the State statutes. Commissioner Long made a motion to approve the question be put on the March 6th ballot. Commissioner Hood seconded the motion and Commissioners Long, Hood, Steward, and Townsend voted aye. Motion passed.
- Question #3 Shall the Board of Commissioners issue licenses to sell distilled spirits for beverage purposes by the drink, such sales to be for consumption only on the premises beginning July 1, 2012. Attorney Smith advised the Board that this is for Board consideration of a resolution by the Board placing the following question on the March 6th ballot for consideration by all of the voters of Gordon County. The question to be considered, pursuant to this resolution is: Shall the Board of Commissioners issue licenses to sell distilled spirits for beverage purposes by the drink, such sales to be for consumption only on the premises beginning July 1, 2012. Commissioner Long made a motion to approve the question be put on the March 6th ballot. Commissioner Steward seconded the motion and Commissioners Long, Steward, Hood, and Townsend voted aye. Motion passed.
