12/21/10 Regular Session Minutes

The Gordon County Board of Commissioners held their Regular Meeting on Tuesday, December 21, 2010, at 10:00 a.m. in the Conference Room of the Administration Building.

Chairman Long called the meeting to order.

INVOCATION AND PLEDGE OF ALLEGIANCE
The invocation was led by Rev. John Allen and the pledge of allegiance was led by Chairman Long.

WELCOME
Chairman Long welcomed everyone to the meeting.

PUBLIC HEARING TO ABANDON A PORTION OF BELWOOD ROAD
Commissioner Bailey made a motion to open the public hearing to abandon a portion of Belwood Road. Commissioner Gordon seconded the motion and all voted aye. Motion passed. County Attorney Hutchinson advised that this is a public hearing to abandon 0.29 acres of Belwood Road adjacent to property owned by Shepherd Motel, Inc. No one signed to speak during the public hearing. Commissioner Bailey made a motion to close the public hearing. Commissioner Gordon seconded the motion and all voted aye. Public Hearing is closed.

APPROVAL OF MINUTES
Chairman Long asked if there were any additions, omissions, or deletions to the Minutes of the Work Session December 7, 2010, and the Regular Meeting December 7, 2010. Commissioner Bailey made a motion to approve the minutes. Commissioner Gordon seconded the motion and all voted aye. Minutes approved.

CONSIDERATION OF NEW BUSINESS

  • DECLARATION OF SURPLUS PROPERTY FOR FOUR COUNTY VEHICLES FROM THE SHERIFF’S DEPARTMENT
    Administrator Dowling advised that this is a declaration for surplus county property of four vehicles from the Sheriff’s Office, for a 1997 Dodge Ram truck, a 1996 Chevy S10 pickup, a 1994 Dodge Ram truck, and a 1994 Oldsmobile 88 Royale. Commissioner Bailey made a motion to approve the declaration of surplus property for four vehicles. Commissioner Gordon seconded the motion and Commissioners Bailey, Gordon, Townsend, and Hood voted aye. Motion passed.
  • RE-APPOINTMENT TO THE PLANNING COMMISSION FOR RON FREE AND BRAD RAINS FOR FOUR YEAR TERMS ENDING 12/31/2014
    Administrator Dowling advised that this is reappointments to the Planning Commission for Ron Free and Brad Rains for four year terms ending 12/31/2014. Commissioner Gordon made a motion to approve the reappointments to the Planning Commission. Commissioner Bailey seconded the motion and Commissioners Bailey, Gordon, Townsend, and Hood voted aye. Motion passed.
  • ABANDONMENT OF A PORTION OF BELWOOD ROAD
    County Attorney Hutchinson advised that this is for Board consideration of abandonment of a portion of Belwood Road. The required notices have been run in the Calhoun Times and a public hearing was held at this meeting. There is only one adjoining property owner, and that property owner has been notified. The property owner has no objection to the abandonment of this portion of the property. This is a portion of right-of-way that was not needed, that the County acquired when Belwood Road was realigned. Commissioner Bailey made a motion to approve the abandonment of a portion of Belwood Road. Commissioner Gordon seconded the motion and Commissioners Bailey, Gordon, Townsend and Hood voted aye. Motion passed.
  • MALT BEVERAGE LICENSE APPLICATION FOR 2011 FOR LOYAL ORDER OF MOOSE #1974
    Administrator Dowling advised that this is an application for a malt beverage license for a new manager for the Moose, all paperwork is in order. Commissioner Gordon made a motion to approve the application. Commissioner Bailey seconded the motion and Commissioners Bailey, Gordon, Townsend, and Hood voted aye. Motion passed.
  • MALT BEVERAGE LICENSE RENEWALS FOR 2011
    Administrator Dowling advised that this is renewal applications for 2011 malt beverage licenses for 20 different locations of businesses that currently hold malt beverage licenses. All paperwork is in order and all application have been paid. Commissioner Bailey made a motion to approve the license renewals for 2011. Commissioner Gordon seconded the motion and Commissioners Bailey, Gordon, Townsend, and Hood voted aye. Motion passed.
  • APPROVAL OF RECOMMENDATION OF RENOMINATION AND REAPPOINTMENT OF NANCY NICHOLS TO THE GORDON COUNTY HOSPITAL AUTHORITY BOARD
    Administrator Dowling advised that this is approval of recommendation of renomination and reappointment of Nancy Nichols to the Gordon County Hospital Authority Board for a three year term ending 12/31/2013. Commissioner Bailey made a motion to approve the recommendation of renomination and reappointment of Nancy Nichols to the Hospital Authority Board. Commissioner Gordon seconded the motion and Commissioners Bailey, Gordon, Townsend, and Hood voted aye. Motion passed.
  • ORDINANCE AMENDMENT FOR OUTDOOR LANDSCAPE WATERING SB370
    County Attorney Hutchinson advised that this is an amendment to the Ordinance for Outdoor Landscape Watering. This is for approval by Gordon County as a requirement pursuant to State Law 370. This amendment is before the Board for approval with one proposed change to the draft amendment, which is to change the language from the enforcement responsibility being the Gordon County Office of Building, Planning & Development, to the Gordon County Ordinance Officer. Commissioner Gordon made a motion to approve the amendment with the change of enforcement responsibility being the Gordon County Ordinance Officer. Commissioner Bailey seconded the motion and Commissioners Bailey, Gordon, Townsend, and Hood voted aye. Motion passed.
  • APPROVAL OF DESIGN FOR TALLATOONA CAP FACILITY
    Administrator Dowling advised that this is for approval of the design of the new Tallatoona Community Action Partnership facility by Killian Clark. Commissioner Bailey made a motion to approve the design. Commissioner Gordon seconded the motion and Commissioners Bailey, Gordon, Townsend, and Hood voted aye. Motion passed.
  • RESOLUTION TO APPEAL MINIMUM NUMBER OF ACRES FOR A PROPERTY TO QUALIFY FOR CONSERVATION USE
    County Attorney Hutchinson advised that this is a resolution to comply with O.C.G.A. Section 48-5-7.4 also known as HB1081. This comes to the Board of Commissioners at the request and the recommendation of the Gordon County Board of Tax Assessors. The purpose of this resolution is to establish the minimum number of acres necessary for inclusion in a conservation use covenant. The Board of Tax Assessors recommends that a property owner have a minimum of 10 acres to be considered for a conservation use covenant. This resolution allows the minimum number of acres to be established by the local governing authority. Commissioner Bailey made a motion to approve the resolution. Commissioner Gordon seconded the motion and Commissioners Bailey, Gordon, Townsend, and Hood voted aye. Motion passed.
