4/21/09 Regular Session Minutes

The Gordon County Board of Commissioners held their Regular Meeting on Tuesday, April 21, 2009, at 7:00 p.m. in the courtroom of the Gordon County Courthouse.

Chairman Long called the meeting to order.

INVOCATION AND PLEDGE OF ALLEGIANCE

Invocation was led by Rev. John Allen and the pledge of allegiance was led by Chairman Long.

WELCOME
Chairman Long welcomed everyone to the meeting.

SPECIAL PRESENTATION
Chairman Long read a proclamation for National Donate Life Month and presented it to Mr. Tim Capin. Mr. Capin accepted the proclamation on behalf of LifeLink and spoke to the meeting about the importance of organ donation. Commissioner Gordon made a motion to open the public hearing. Commissioner Bailey seconded the motion and all voted aye.

PUBLIC HEARING FOR HISTORIC OVERLAY DISTRICTS

Mr. Jimmy Phillips, Mr. Larry Gilbert, Mr. Brian Gilbert, Ms. Bettye Gilbert, Mr. Jule Medders, Mr. James Brogdon, Mr. Ken Padgett, Mr. Paul Lusk, Mr. Jonathan Fortin, Ms. Glenda Allen, Ms. Beth Grubbs, and Mr. Jonathan Moss came before the Board to speak regarding their concerns with, or their support of, the historic overlay districts. Commissioner Bailey made a motion to close the public hearing. Commissioner Hood seconded the motion and all voted aye.

APPROVAL OF MINUTES
Chairman Long asked if there were any additions, omissions, or deletions to the Minutes for the Work Session April 7, 2009, and the Regular Meeting April 7, 2009. Commissioner Bailey made a motion to approve the minutes. Commissioner Gordon seconded the motion and all voted aye. Minutes approved.

CONSIDERATION OF NEW BUSINESS

  • ORDINANCE AMENDMENT TO THE ULDC FOR HISTORIC OVERLAY DISTRICTS – FIRST READING
    County Attorney Hutchinson advised that this is the first reading of the ordinance amendment that was discussed in the public hearing for the Unified Land Development Code for the historic overlay districts. County Attorney read the ordinance amendment by title only and advised that the ordinance amendment would be on the agenda at the next Regular Meeting for the second reading.
  • BID AWARD FOR A COMMERCIAL MOWER FOR SALACOA CREEK PARK
    County Administrator Dowling advised that this is a bid award for a commercial mower for the Salacoa Creek Park. Gordon County solicited for sealed bids and various vendors responded. The low bid is from Coles Equipment at $7,272. The recommendation is to award the bid to Coles Equipment.
    Commissioner Gordon made a motion to award the bid to Coles Equipment. Commissioner Bailey seconded the motion and Commissioners Bailey, Hood, Gordon, and Townsend voted aye. Motion passed.
  • BID AWARD FOR RENOVATION OF THE BOYS & GIRLS CLUB FACILITY
    County Administrator Dowling advised that this is a bid award for the renovation of the Boys and Girls Club Facility. Killian and Clark, the architectural firm the County hired, prepared renovation documents and solicited for sealed bids. The low bidder was Momon Construction at $55,000. Killen and Clark and county staff is recommending that Momon Construction be awarded this bid.
    Commissioner Bailey made a motion to approve Momon Construction to handle the renovation on this project. Commissioner Gordon seconded the motion and Commissioners Bailey, Gordon, Hood, and Townsend voted aye. Motion passed.
  • CONTRACT WITH MOMON CONSTRUCTION FOR RENOVATION OF BOYS & GIRLS CLUB FACILITY
    County Attorney Hutchinson advised that this is a contract between Gordon County and Momon Construction in the bid award amount of $55,000. Those funds will be provided by the Boys and Girls Club.
    Commissioner Bailey made a motion to approve the contract with Momon Construction. Commissioner Gordon seconded the motion and Commissioners Bailey, Gordon, Townsend, and Hood voted aye. Motion passed.


  • BID AWARD FOR SOD FOR SONORAVILLE RECREATION COMPLEX
    County Administrator Dowling advised that this is a bid award to furnish and install sod for the Sonoraville Recreation Complex. Gordon County solicited for bids and various vendors responded. The lowest responsible bid was from Georgia Turf Farms in the amount of $7,600. The recommendation is to award the bid to Georgia Turf Farms.
    Commissioner Bailey made a motion to award the bid to Georgia Turf Farms. Commissioner Gordon seconded the motion and Commissioners Bailey, Gordon, Hood, and Townsend voted aye. Motion passed.
  • CONSIDERATION OF SUBMITTING A FIRE ACT GRANT
    County Administrator Dowling advised the Board that this is a request from Fire Chief Hawkins to submit a federal assistants Firefighters Grant application for turnout gear and a brush truck, and a regional grant for undetermined items. The grants will require a 20% match per grant.
    Commissioner Gordon made a motion to approve submitting a Fire Act Grant for the Fire Department. Commissioner Bailey seconded the motion and Commissioners Gordon, Bailey, Townsend, and Hood voted aye. Motion passed.
  • REQUEST FROM TOWN OF RESACA FOR GORDON COUNTY BOARD OF ELECTIONS TO CONDUCT ELECTIONS FOR THE TOWN OF RESACA
    County Attorney Hutchinson advised the Board that this item comes to the Board from the Gordon County Board of Elections and Voter Registration. A request from the Town of Resaca was made to the Election Superintendent that the Board of Elections conduct the Town of Resaca’s election in 2009. The Board of Elections has agreed to that request. This comes to the Board of Commissioners with a request for approval. If the Board of Commissioners approves this request, a contract would have to be drafted outlining the duties and responsibilities of the Town of Resaca and the Board of Elections.
    Commissioner Gordon made a motion to approve the request for the Board of Elections to conduct the Town of Resaca’s elections in 2009. Commissioner Bailey seconded the motion and Commissioners Gordon, Bailey, Hood, and Townsend voted aye. Motion passed.
  • MALT BEVERAGE & WINE APPLICATION FOR MARTIN CORNERS
    County Administrator Dowling advised that this is an application from Martin Corners for a malt beverage and wine license. This is a new establishment on Cash Road in Calhoun. All paperwork is in order and staff recommends approval.
    Commissioner Bailey made a motion to approve the application. Commissioner Gordon seconded the motion and Commissioners Bailey, Gordon, Hood, and Townsend voted aye. Motion passed.
  • INTENT TO ABANDON ROADS – PORTIONS OF PINE DRIVE, FIELD ROAD, AND SALEM ROAD
    County Attorney Hutchinson advised the Board that this a request from the Gordon County Road Superintendent to consider the abandonment of a portion of Pine Drive, Field Road NE, and Salem Road. County Attorney Hutchinson read the motion for intent to abandon these roads (copy attached).
    Commissioner Bailey made a motion to approve the Intent to Abandon the portion of the roads as outlined. Commissioner Gordon seconded the motion and Commissions Bailey, Gordon, Hood, and Townsend voted aye. Motion passed.
    County Attorney Hutchinson advised that pursuant to that motion, the required notice will be published in the Calhoun Times and this matter would be eligible for a public hearing to consider this request at the May 19 Regular Meeting of the Board of Commissioners.


  • APPOINTMENT TO THE BOARD OF TAX ASSESSORS FOR WALTER WALRAVEN
    County Administrator Dowling advised that this is an appointment to the Board of Tax Assessors for an unexpired term ending December 13, 2013.
    Commissioner Bailey nominated Walter Walraven to fill the unexpired term on the Board of Tax Assessors. Commissioner Hood seconded the motion and Commissioners Bailey, Hood, Townsend, and Gordon voted aye. Motion passed.


ADJOURNMENT

Commissioner Bailey made a motion to adjourn the meeting. Commissioner Gordon seconded the motion and all voted aye. There being no further business, the meeting was adjourned at 8:00 p.m.
