6/15/10 Regular Session Minutes

The Gordon County Board of Commissioners held their Regular Meeting on Tuesday, June 1, 2010, at 6:00 p.m. in the Conference Room of the Administration Building.

Vice Chairman Bailey called the meeting to order.

INVOCATION AND PLEDGE OF ALLEGIANCE
The invocation was led by Rev. John Allen and the pledge of allegiance was led by Vice Chairman Bailey.

WELCOME
Vice Chairman Bailey welcomed everyone to the meeting.

Commissioner Gordon made a motion to go into the public hearing for the ULDC.
Commissioner Hood seconded and all voted aye.

PUBLIC HEARING FOR AMENDMENT TO UNIFIED LAND DEVELOPMENT CODE
No one signed to speak at the public hearing. Commissioner Gordon made a motion to close the public hearing. Commissioner Hood seconded the motion and all voted aye.

APPROVAL OF MINUTES
Vice Chairman Bailey asked if there were any additions, omissions, or deletions to the Minutes of the Work Session June 1, 2010, and the Regular Meeting June 1, 2010. Commissioner Hood made a motion to approve the minutes. Commissioner Gordon seconded the motion and all voted aye. Minutes approved.

CONSIDERATION OF OLD BUSINESS

None

  • FISCAL YEAR 2010-2011 BUDGET ADOPTION RESOLUTION
    Administrator Dowling read the resolution for adoption of the fiscal year 2010-2011 budget. Commissioner Gordon made a motion to approve the budget resolution and adopt the budget. Commissioner Hood seconded the motion and Commissioners Gordon, Townsend, and Hood voted aye. Motion passed.
  • ORDINANCE AMENDMENT TO THE UNIFIED LAND DEVELOPMENT CODE – 1st reading
    County Attorney Hutchinson advised the Board that this is a first reading of the amendment to the Unified Land Development Code. There are three proposed amendments; the replacement of the entire existing soil and erosion sedimentation chapter, which is mandated by the State of Georgia if we wish to continue as the licensing authority; the seconded one is to correct a conflict in the existing ordinance concerning the issuance of stop-work orders; the third amendment has to do with correcting some definitions and adding some acronyms to the existing ordinance. The County Attorney requested approval from the Board to do a first reading by title only rather than to read the documents. Commissioner Gordon made a motion to approve reading the amendments by title only. Commissioner Hood seconded the motion and Commissioners Gordon, Hood, and Townsend voted aye. Motion passed. County Attorney Hutchinson advised the Board that this ordinance amendment will be on the agenda of the next meeting for the second reading and for Board consideration for approval.
  • ORDINANCE REGULATING PAWN SHOPS AND PAWN BROKERS – first reading
    County Attorney Hutchinson advised that this is the first reading of a proposed ordinance entitled Regulation of Pawn Shops and Pawn Brokers. This ordinance comes to the Board at the request of the Gordon County Sheriff’s Department. The City of Calhoun and surrounding counties and cities have also previously adopted this ordinance. The purpose of the ordinance would be to require anyone operating a pawn shop to file an annual registration with the Gordon County Sheriff’s Department. They would also be required as the owner of a pawn shop to record any transactions which occur in their pawn shop and to keep those records electronically. There would also be a required waiting period for the disposal of certain articles. Commissioner Gordon made a motion to approve the first reading by title only. Commissioner Hood seconded the motion and Commissioners Gordon, Hood, and Townsend voted aye. Motion passed. County Attorney Hutchinson advised that the ordinance will be on the next agenda for a second reading and will be presented for the consideration of the Board for approval.


  • COOPERATIVE AGREEMENT BETWEEN GEORGIA FORESTRY COMMISSION AND GORDON COUNTY COMMISSIONERS PURSUANT TO GENERAL ASSEMBLY HB1055
    County Administrator Dowling advised the Board that this is an agreement that the County has had for many years where the County would fund the Georgia Forestry Commission $.04 per acre, which has been about $4,500 per year. The General Assembly enacted HB1055 which increased the $.04 per acre to $.10 per acre, resulting in this agreement. Commissioner Hood made a motion to approve the agreement. Commissioner Gordon seconded the motion and Commissioner Hood, Gordon, and Townsend voted aye. Motion passed.
  • APPROVAL OF 2010-2011 ROAD IMPROVEMENT PROGRAM AND LARP
    County Administrator Dowling advised that this is for Board approval of the 2010-2011 Road Improvement Program and LARP. This is an annual program for spending SPLOST funds to pave various roads; the Road Superintendent has comprised this list of 20.77 miles. The LARP is D.O.T. funded and is an additional 9.37 miles. Commissioner Gordon made a motion to approve the Road Improvement Program and LARP. Commissioner Hood seconded the motion and Commissioners Gordon, Hood, and Townsend voted aye. Motion passed.
  • APPROVAL OF INTERGOVERNMENTAL AGREEMENT BETWEEN THE GEORGIA ENVIRONMENTAL FACILITIES AUTHORITY AND GORDON COUNTY FOR THE ENERGY EFFICIENCY AND CONSERVATION BLOCK GRANT PROGRAM TO CONSTRUCT A SOLAR FARM AT THE HARRIS BEAMER LANDFILL
    County Administrator Dowling advised that this is for Board approval of an intergovernmental agreement between the Georgia Environmental Facilities Authority and Gordon County for the Energy Efficiency and Conservation Block Grant program to construct a solar farm at the Harris Beamer Landfill. The county applied to GEFA for this block grant and was awarded the grant. This is the document to be executed for accepting $300,000 to build a solar farm. By accepting these funds, the county is committed to build a solar farm on the landfill between now and June 2012. In a future meeting the Board will contract with Sentinex who prepared the grant, and Sentinex would implement all the items in the GEFA document and would have until 2012 to build a small solar farm. Commissioner Hood made a motion not to accept the grant funds. Commissioner Gordon seconded the motion and Commissioners Hood and Gordon voted aye. Commissioner Townsend abstained from voting. County Attorney Hutchinson advised that it takes three votes to have a majority to pass a motion. No motion was approved by the Board. County Administrator Dowling advised that the deadline to present these documents back to GEFA is today and that subsequently the funds would no longer be available. Vice Chairman Bailey asked the Administrator to confirm this with GEFA.
  • APPOINTMENT TO THE CALHOUN/GORDON COUNTY LIBRARY BOARD
    Administrator Dowling advised that this is an appointment to the Calhoun/Gordon County Library Board for Angela Harris for a three year term. Commissioner Gordon made a motion to appointment Angela Harris to the Library Board. Commissioner Hood seconded the motion and Commissioners Gordon, Hood, and Townsend voted aye. Motion passed.

Commissioner Hood made a motion to adjourn the meeting. Commissioner Gordon seconded the motion and all voted aye. There being no further business, the meeting was adjourned at 6:30 p.m.
